JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 09-11-2023 Learned counsel for the petitioners is permitted to remove the defect(s), as pointed out by the office, if any, within a period of three weeks from today.
2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
3. The petitioners are apprehending their arrest in connection with Shashtrinagar P.S. Case No. 811 of 2022 dated 20.01.2022 registered for the offences punishable under Sections 418, 419, 420 and 120B of the Indian Penal Code.
4. As per the prosecution case, the petitioner No. 1 with the help of petitioner No. 2 made a forged copy of the rent
Patna High Court CR. MISC. No.46629 of 2023(3) dt.09-11-2023 2/3 agreement of the informant and got the GST number and proprietorship of Ad Idea Creation registered in his name. The informant has given the petitioner No. 1 Rs. 10,000/- along with documents for opening a Bank account for the new firm "Ad Idea Creation" but the petitioner No.1 got the account opened in his own single name. It has been further alleged that the petitioner No. 1 used to introduce himself as business partner of the informant to the advertisers, vendors and embezzled lakhs of rupees. The petitioner No.1 also used to carry out illegal activities in the absence of the informant from his rented flat. Further it has been alleged that the petitioner No. 1 being a part time employee in the informant's company, possessed the informant's mail ID and password, sent the purchase order details of the customers to the business competitors of the informant which caused him loss of lakhs of rupees.
5. Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case. The petitioners have no criminal antecedent as stated in para 3 of the bail petition. Learned counsel has further submitted that the petitioner No. 1 is registered owner of Ad Idea Advertisements as such he was never a part-time or full-time employee of the informant. It is further submitted that there is

6. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioners.
7. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Shashtrinagar P.S. Case No. 811 of 2022, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
8. This application stands allowed.
