2. Learned counsel for the petitioner informs this Court that the petitioner has already filed his representation before the Secretary, Rural Development Department, Govt. of Bihar on 18.08.2023 and the same is pending till date.

3. Learned counsel further submits that the representation of the petitioner is required to be disposed of

Patna High Court CWJC No.10466 of 2024(2) dt.19-07-2024 2/2 after giving the petitioner due opportunity of hearing and also considering the order passed in C.W.J.C. No. 3869 of 2023 in the case of Hridya Nand Rai Vs. State of Bihar and Ors., in which the petitioner in that case was also as Panchayat Rojgar Sewak under the MGNREGA.

4. Considering the aforesaid submission made on behalf of the petitioner, the Secretary, Rural Development Department, Govt. of Bihar, is directed to dispose of the representation of the petitioner in accordance with law which is pending for a long period of time. In case he finds that the petitioner do not deserve any relief in that case, the petitioner is required to be given due opportunity of hearing before passing an order in accordance with law.

5. The above exercise is directed to be concluded within a period of two months from the date of communication of this order.
