The petitioners seek anticipatory bail in a case instituted for the offence under Sections 341, 323, 379, 307, 304 and 506/34 of the Indian Penal Code.
It has been submitted that there is specific allegation against co-accused Pradip Kumar Jha of giving iron rod blow on the head of the informant. It has further been submitted that there is allegation against the petitioners No. 1 of assaulting with lathi and allegation against the petitioner No. 2 of taking away Rs. 10,000/-. In this manner, there is general and omnibus allegation against both the petitioners.
Considering the facts and circumstances of the
Patna High Court Cr.Misc. No.3364 of 2017 (2) dt.06-02-2017 2/2 case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Sarsi P.S. Case No. 88 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri D. Prakash, Judicial Magistrate, 1st Class, Purnea, subject to the conditions as laid down under Section 438
