JUSTICE PARTHA SARTHY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 05-09-2024 The petitioners are concerned with the construction of a building, which even according to the petitioners, was by a company called Wow Infra Private Limited, Kaptanpara Khuskibagh, P.S- Sadar, District- Purnia.

2. We directed the petitioners to implead the company as party respondent, which has been done as additional Respondent no. 21.

3. The Municipal Corporation has filed a counter affidavit which clearly states that Respondent no. 20 obtained all permissions and started development work over the aforesaid land. It is also stated that verification was conducted by the order of the Municipal Commissioner, Municipal Corporation, Purnia and during the verification, it was found that no damage is being done to the Saura river and the construction is being done 100 meters away from the river.

4. Considering the counter affidavit filed by the Municipal Corporation, we do not think there is any reason to keep the matter pending.
