JUSTICE SANJAY PRIYA ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in Mahishi P.S. Case No.147 of 2016 instituted for the offence under Sections 341, 323, 379, 384, 386, 504, 506/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that there is a case and counter case. He has clean antecedent. As per allegation, on the date of occurrence, when the informant was returning with his son, these petitioners and other accused persons surrounded him and told him to execute the sale deed with respect to the land and on refusal they demanded Rs.3 lacs as Rangdari and snatched Rs.15,000/- from him.

It is mentioned in paragraph 3 that the petitioner has

In the circumstances, prayer of the petitioner for anticipatory bail is allowed.

In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Mahishi P.S. Case No.147 of 2016, he shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sri N.P. Singh, J.M.-1st Class, Saharsa, subject to the conditions as laid down under Section 438(2) Cr.P.C.
