JUSTICE SANJAY PRIYA ORAL ORDER 3/ 26-04-2018 Heard learned counsel for the petitioners and learned APP for the State as well as counsel for the Informant. Petitioners apprehend their arrest in Dehri Dalmiya Nagar P.S. Case No.998 of 2017 instituted for the offence under Section(s) 302/34 Indian Penal Code pending in the Court of the SDJM, Dehri, Rohtas.
Counsel for the Petitioners has submitted that Petitioners are parents-in-law of the deceased. There is general and omnibus allegation against the petitioners. Counsel for the Informant has submitted that process under Section 82-83 Cr. P. C. has already been issued against the Petitioners.
Patna High Court Cr.Misc. No.17274 of 2018 (3) dt.26-04-2018 2/2 Learned APP after looking into the case diary has submitted that process under Section 82 Cr. P. C. has already been issued, as mentioned in para 87 of the case diary, and the same has been executed as mentioned in para 94 of the case diary.
In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioners for grant of anticipatory bail is rejected.
Petitioners may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law on without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
