Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-08-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest in connection with Harlakhi P.S. Case No.83 of 2021, registered for the offences punishable under Sections 341, 323, 307, 354, 379 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is case and counter case between the parties and both sides sustained injuries. It is further submitted that the occurrence took place on 25.03.2021 and the said FIR was sent to the court on 01.04.2021. There is delay in sending the FIR to the court below. Learned counsel for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts that there is case and counter case between the parties and the injuries sustained by the injured person are simple in nature, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Benipatti, District Madhubani in connection with Harlakhi P.S. Case No.83 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
