JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 30-08-2025 In view of the supplementary affidavit filed on behalf of the petitioner, petitioner is permitted to correct the year of case in para 1 of the petition in the course of the day.

2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner apprehends arrest in connection with Barharia P.S. Case No. 214 of 2023 for the offence registered under Section 30(a) of Bihar Prohibition & Excise Act.

4. As per the prosecution case, 45 litres country made liquor was recovered from a motorcycle. It is alleged that the petitioner managed to escape.

5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. It has also been submitted by the learned counsel that nothing has

Patna High Court CR. MISC. No.46147 of 2025(3) dt.30-08-2025 2/2 been recovered from the possession of the petitioner. Petitioner has no concern with the seized motorcycle and illicit liquor. The petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and trial.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise, Court No. 1, Siwan, in connection with Barharia P.S. Case No. 214 of 2023, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
