JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons assaulted father of the informant but father of the informant died due to assault made by accused Lila Devi. It is submitted on behalf of the petitioner that he has got no criminal antecedent. There is no injury attributed against the petitioner. The main allegation has been made against co-accused Lila Devi. There is admitted enmity between the parties. On behalf of the State, it is submitted that petitioner is named in the F.I.R. and was present at the place of occurrence when the occurrence had taken place.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.
Any how, if petitioner surrenders in the court below, i.e., learned Sub Judge-III cum A.C.J.M., Muzaffarpur, in connection with Mushahari P. S. Case no. 204 of 2015 within a period of six
Patna High Court Cr.Misc. No.10961 of 2016 (2) dt.18-04-2016 2/2 weeks from the date of receipt of a copy of this order and prays for regular bail, same shall be considered and disposed of taking into account the commission made on behalf of the petitioner preferably on the same day without being prejudiced by this order.
