JUSTICE BIRENDRA KUMAR ORAL ORDER 04-05-2017 Heard the learned counsel for the petitioners and the State.

This is a petition for grant of anticipatory bail for offence under Sections 420, 406 and 34 of the Indian Penal Code.

The informant, Rekha Devi, was agent of Barkha Finance Insurance Company, Kashinath More, Gaya. She has alleged that she had deposited money of different

Patna High Court Cr.Misc. No.9423 of 2017 (4) dt.04-05-2017 2/2 customers in the said Company and the Company fled away along with the money.

Submission of the petitioners is that the petitioners were earlier agents of the said Company and they are also victim of the circumstance. The petitioners have produced supporting documents that they were agents of the Company by filing supplementary affidavit. Considering the aforesaid fact, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Gaya Civil Line P.S. Case No. 127 of 2016 G.R. No. 1690 of 2016 to the satisfaction of the Chief Judicial Magistrate, Gaya, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
