It is submitted by learned counsel for the petitioners that during pendency of the instant petition, petitioner No. 2 has already been arrested.

As petitioner No. 2 has been arrested pre-arrest bail petition for petitioner No. 2 is dismissed as withdrawn. Petitioner No. 1 apprehends arrest in a case registered for the offences punishable under Sections 30(a), 30(d) of the Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution case, 35 litres country made liquor has been recovered from the house of co-accused Ashok Kumar.

Patna High Court CR. MISC. No.45300 of 2022(2) dt.21-10-2022 2/2 Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and in no way she is connected with the aforesaid recovery. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of her arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court I, Bhojpur at Ara in Jagdishpur P. S. Case No. 299 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
