Tiwary, learned counsel for the petitioner and Mr. Vijay Kr. Verma, A.C. to G.A.-2. This writ petition has been filed for setting aside the notice bearing letter No. 204 dated 24.1.2014 issued from the level of respondent designated Officer-cum-Divisional Forest Officer, Rohtas, Forest Division, Sasaram, addressed to learned Chief Judicial Magistrate, Rohtas at Sasaram with regard to initiation of confiscation proceeding against petitioner's vehicle of Tata Truck bearing Registration No. U.P.60T-3093 which is said to be seized in contravention of provisions of the Forest Act.

Counter affidavit has been filed on behalf of the State

Patna High Court CWJC No.9224 of 2015(5) dt.03-01-2019 2/2 stating therein that in pursuance of the aforesaid notice, the petitioner has appeared and final order for confiscation of vehicle has been passed on 12.02.2015. The aforesaid order has been enclosed as Annexure-B to the counter affidavit. In such circumstances, this writ petition has become infructuous.
