The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 188 and 120B of the Indian Penal Code, and sections 30(a)(d) and 36 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, a total of 260 litres of liquor was recovered from the motorcycle being driven by the petitioner and one another.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 5.4.2022(Annexure-1) giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 10.7.2021.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner, the liberty granted to the petitioner in the earlier order of rejection dated 5.4.2022 and the petitioner having remained in custody for more than one year, the petitioner is directed to be enlarged on bail in connection with Bachhwara P.S. Case no. 147 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Judge I, Begusarai.
