2. The petitioner is apprehending arrest in connection with Andhratharhi P.S. Case No. 143 of 2023, lodged on 08.10.2023, for offences punishable under Sections 341, 323, 354B, 384, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution story F.I.R. has been lodged against six named accused persons with an allegation that they have demanded ransom of Rs. 50,000/- from the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner has clean antecedent and from the F.I.R., it becomes crystal clear that the Genesis of the dispute is land. He further submits that there is a title suit pending between the
Patna High Court CR. MISC. No.49254 of 2024(3) dt.18-09-2024 2/2 petitioner and the father of the informant which is annexed as Annexure P/3 bearing Title Suit No. 123 of 2023 and the present case has been lodged in the year 2023.
5. Learned APP for the State opposes the prayer for bail.
6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs. 30,000/- (Thirty Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Madhubani subject to the condition as laid down under Section 438(2) Cr.P.C.
