JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2018 Petitioner apprehends his arrest in connection with Jokihat (Mahalgaon) P.S.Case No. 325 of 2016 registered for the offences punishable under Sections 420, 406, 409, 120B, 325, 504 and 34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be Mukhiya, is that informant was allotted widow pension and she has not been given the same.

Submission of learned counsel for the petitioner is that period of pension was 2007-08 and at that time he was not the Mukhiya. Further submission is that list of allottees of widow pension was called (Annexure 2/B) which shows that the informant did not get the pension as such the whole case is false and concocted.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Jokihat (Mahalgaon) P.S.Case No. 325 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
