The petitioner apprehend his arrest in connection with Rafiganj P.S. Case No. 69 of 2016, registered under Section 392 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of the Chief Judicial Magistrate, Aurangabad.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Further submission is that on the basis of written report of informant Sakaldeep Mandal Rafiganj P.S. Case No. 69 of 2016, registered under Section 392 of the Indian Penal Code and Section 27 of Arms Act was instituted against unknown and in course of investigation, the name of petitioner surfaced in the confessional statement of co-
Patna High Court Cr.Misc. No.5917 of 2017 (2) dt.03-04-2017 2/2 accused Raghunandan Saw, except that there is nothing against the petitioner to show his involvement in the present case. On the other hand, learned A.P.P. appearing on behalf of the State opposed the prayer of anticipatory bail of the petitioner and submits that informant has detailed the physic of the culprit.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. (Rajendra Kumar Mishra, J) manish/- U T
