The petitioner apprehends his arrest in connection with Uchakagaon P.S. Case no. 103 of 2019, registered under Sections 341, 323, 356 and 379/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The accusation is that informant Shambhu Singh was present on the road, at that time, two persons came on motorcycle and made query about way of village-Harpur. In the meanwhile, the person, who was sat on the rear seat snatched his mobile, when informant made protest then he caused injury at his head and started to flee away snatching his mobile. The person, who was sat on the rear seat of the motorcycle was apprehended by the informant. In the meantime, villagers

Patna High Court CR. MISC. No.42559 of 2019(2) dt.10-07-2019 2/2 reached there and both were caught hold, but one person managed to escape from there leaving the motorcycle. The apprehended person disclosed his name as Quyum lam and he also disclosed the name of his associate as Aashique @ Bhagelu (Petitioner). On search of the motorcycle, one bottle containing 200 ML country made liquor recovered. Learned counsel for the petitioner submits that petitioner was not apprehended on the spot, rather, his name has been disclosed by co-accused Quyum Alam, who is said to be apprehended on the spot. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-IIcum-Special Judge, Gopalganj in connection with Uchakagaon P.S. Case No. 103 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
