====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is seeking anticipatory bail in connection with Mahindwara P.S. Case No. 29/2019 registered under Sections 30(a)(b)(c)(f), 34, 36, 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that no illicit liquor has been recovered from the possession of the petitioner and his name has been transpired in the statement of co-accused. Learned counsel submits that some of the coaccused have been granted privilege of anticipatory bail by learned coordinate Bench of this court.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.44039 of 2019(4) dt.25-09-2019 2/2 whereunder the illicit liquor has not been recovered from the possession of this petitioner and the name of the petitioner has transpired in the statement of co-accused and some of the similarly situated co-accused have been granted privilege of anticipatory bail by the learned coordinate Bench of this court, let the petitioner above-named, in the event of his arrest/surrender before the court below within a period of four weeks, be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge - II, cum Special Judge, Excise Act, Sitamarhi, in connection with Mahindwara P.S. Case No. 29/2019 subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
