2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30 (a) of the Bihar Prohibition and Excise Act, registered in connection with Pranpur P.S. Case No. 40 of 2024.

3. As per prosecution case, there has been recovery of 137.280 liters of liquor from a Car, which was being driven by petitioner.

4. The learned counsel for the petitioner has submitted that he has been falsely implicated in this case and has committed no offence. Petitioner has no concern either with the seized car or with the alleged recovery of liquor. No

Patna High Court CR. MISC. No.48690 of 2024(2) dt.11-07-2024 2/2 incriminating article has been recovered from the conscious possession of the petitioner. Petitioner is a person of clean antecedent and he is in custody since 16.03.2024.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case, petitioner has clean antecedent as well as period of custody, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-cum-Exclusive Excise Court No. 2, Katihar in connection with Pranpur P.S. Case No. 40 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court.
