2. The petitioner apprehends her arrest in a case registered for the offence under Sections 302, 120(B)/34 of the Indian Penal Code.
3. The informant, son of the deceased, got an information on his mobile by his Phupha that his father has been killed near poultry farm. Informant suspects that all the named accused persons including petitioner, on account of land dispute between the parties and also due to previous threat allegedly made by this petitioner & others, committed the alleged offence.
4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence and has raised
Patna High Court CR. MISC. No.43383 of 2025(5) dt.17-11-2025 2/2 suspicion against this petitioner and others only on account of land dispute and alleged previous threat. Similarly situated coaccused Suganti Devi (mother of petitioner) has been granted bail by a coordinate Bench of this Court, vide order dated 22.04.2025 passed in Cr.Misc. No. 19585 of 2025 (Annexure P/2). Petitioner claims clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court concerned within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Barharia P.S. Case No. 26 of 2023, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482 of the B.N.S.S.
