06-07-2017 Heard Sri Amit Kumar Anand, learned counsel for the petitioner and Sri Pranav Kumar, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Purnea Sadar P.S. Case No. 442 of 2016 registered for offence under Sections 272 & 273 of the Indian Penal Code and Section 30 of the Bihar Prohibition & Excise Act, 2016, has prayed for grant of bail in the event of arrest or surrender.
It was submitted by learned counsel for the petitioner that petitioner has been named as accused in the F.I.R. on the basis of statement made by the accused, who was apprehended with one person alongwith pick-up van carrying about 122 bottles of Indian made foreign liquor (Royal Stag). He submits that his name has come as if accused persons, who were arrested, were going to
Patna High Court Cr.Misc. No.15933 of 2017 (4) dt.06-07-2017 2/2 supply the seized articles to the petitioner. By way of referring to statement made in paragraph - 3 of the petition, he submits that petitioner has no criminal antecedent.
Sri Pranav Kumar, learned Addl. Public Prosecutor has opposed the prayer for grant of bail.
However, considering the fact that petitioner has been named as accused on the disclosure made by the co-accused and nothing was recovered from the possession of the petitioner as well as the nature of accusation, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Chhotu Ram be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Purnea Sadar P.S. Case No. 442 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
