JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2018 The petitioner is apprehending his arrest in connection with Sabour (Goradih) P.S. Case No. 53/2017, registered for offences punishable under Sections 147, 149, 341, 323, 342, 354(A), 354(b), 355, 307, 504 and 506 and 509 of the Indian Penal Code and Section 3(iii)(xi) of the SC/ST Act. Allegation against the petitioner and others is of assault to the informant and one Ranjit Paswan and further allegation that her hair was removed and she along with the said Ramjit Paswan was paraded in the village after putting the garland of shoes. It has been submitted on behalf of the petitioner that no specific allegation of overt act has been attributed to the petitioner and in this case large number of persons have been made accused. It has also been submitted that other co-accused persons of this

No.28778 of 2018 (4) dt.18-06-2018 2/3 case having similar allegation has already been granted the privilege of anticipatory bail by the different coordinate Benches of this Court vide order dated 11.10.2017 passed in Cr. Misc. No. 45799 of 2017 and vide order dated 01.12.2017 passed in Cr. Misc. No. 54055 of 2017.

Having heard both sides, considering the facts and circumstances of the case as well as the fact that other co-accused having similar allegation has already been granted the privilege of anticipatory bail, as such, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM -X, Bhagalpur, in connection with Sabour (Goradih) P.S. Case No. 53/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

No.28778 of 2018 (4) dt.18-06-2018 3/3 (ii) The petitioner shall cooperate in the investigation and make himself available as and when required by the police and on the event of failure on his part to appear before the police on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bonds.
