JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2019 This is an application for grant of anticipatory bail in connection with Bihar P.S. Case No. 540 of 2018, disclosing offences under Sections 363, 365, 34 of IPC. Allegation against the petitioner is of taking away 10 years old daughter of the informant and having sexual intercourse with her.

Submission of the learned counsel for the petitioner is that the entire family members have been made accused in this case, due to previous enmity and no such occurrence took place, which will appear from the medical report.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation as

Patna High Court CR. MISC. No.43083 of 2019(2) dt.12-07-2019 2/2 the victim is minor, I am not inclined to grant privilege of anticipatory bail to the petitioner.
