The petitioner seeks bail in a case registered under Sections 401, 413, 414, 467, 468, 420 of the Indian Penal Code. Allegation is that the accused persons have committed theft of petrol from other motorcycles.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.07.2016. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation of committing theft of petrol from another motorcycle is denied by the petitioner. The petitioner has remained in custody for approximately three years.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge IVth, Darbhanga in connection with S.T. No.99 of 2017 arising out of Bahadurpur P.S. case No.297 of 2016.
