The petitioners apprehend their arrest in Complaint Case No. 323-C of 2015 instituted for the offence under sections 498(A), 323, 341, 504, 34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
It has been submitted that the petitioners are fatherin-law and mother-in-law of the complainant respectively. It has further been submitted that the girl (complainant) herself does not want to live with the husband. She has filed a divorce suit no. 46 of 2016 before the Principal Judge,
Patna High Court Cr.Misc. No.10705 of 2017 (2) dt.18-03-2017 2/2 Family Court, Madhepura.
From the complaint petition, it appears that there is general and omnibus allegation against these petitioners. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners named above, within six weeks from today, in connection with Complaint Case No. 323-C of 2015, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Subdivisional Judicial Magistrate, Udakishunganj, Madhepura, subject to the conditions as laid down under Section 438(2) Cr.P.C.
