The petitioners seek bail in a case registered for the offence punishable under Sections 302 and 201/34 of the Indian Penal Code.

Earlier, prayer for bail of the petitioners was rejected vide order dated 09.12.2020 passed in Cr. Misc. No. 24113 of 2020.

In pursuance to the order dated 22.09.2021, status report of trial in connection with Sessions Trial No. 13 of 2021 arising out of Rajoun P.S. Case No. 92 of 2020 has been received, in which it is reported that summons had already been issued to all the charge-sheeted witnesses of this case and trial most likely to be concluded within a period of 9-10 months. Considering the present stage of the trial, I am not

Accordingly, their payer for bail is rejected in connection with Sessions Trial No. 13 of 2021 arising out of Rajoun P.S. Case No. 92 of 2020 pending before the court of the learned Additional and Sessions Judge-III, Banka.

Accordingly, the application is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of nine months from the date of initiation of normal physical proceeding and /or through Video Conferencing and S. S.P., Banka is directed to ensure production of the witnesses in the case on each and every date fixed without fail.
