JUSTICE MADHURESH PRASAD ORAL ORDER 27-08-2018 Counsel for the respondent State submits that upon recommendation of the Selection Committee dated 6.5.2016 one Dr. Vinod Kumar Suman has been appointed as Regular Director in the Rural Institute, Birauli, Samastipur under notification dated 19.5.2016, issued by the Education Department. In view of the said development subsequent to filing of the writ petition, he submits that the relief prayed for has become in-fructuous. It is pointed out that the writ petition was filed challenging the advertisement inviting application for appointment to the said post. Though copy of counter affidavit has been served upon counsel for the petitioner on 10.4.2017

Patna High Court CWJC No.5196 of 2015 (4) dt.27-08-2018 2/2 placing on record the fact of appointment of said Dr. Vinod Kumar Suman, till date neither re-joinder has been filed nor the selection/appointment of Dr. Vinod Kumar Suman has been challenged.

Since none appears on behalf of the petitioner, without going into merits of the submissions made by learned counsel for the respondent State, the writ petition is dismissed for want of prosecution.
