Petitioner seeks bail in connection with Bhimpur P.S. Case No. 61 of 2016 registered under Sections- 406 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner delivered the entire purchased paddy to the miller who supplied lesser quantity of rice. Petitioner requested the miller to deposit the misappropriated amount. Ultimately petitioner filed complaint case against the miller. A reply to the counter affidavit has been filed on behalf of the petitioner stating therein that petitioner returned 385.25 quintal CMR to
Patna High Court Cr.Misc. No.8386 of 2017 (5) dt.21-04-2017 2/2 the BSFC Ltd. In support of the same a receipt dated 12.03.2016 has also been enclosed therein. Petitioner is a man of clean antecedent.
Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Bhimpur P.S. Case No. 61 of 2016.
