Petitioner apprehends his arrest in Dulhin Bazar P.S. case no. 171 of 2013 instituted for the offence under Section(s) 147,148,149, 323, 324, 307 and 379 of the Indian Penal Code. In the written report there is specific allegation against this petitioner of assaulting the son of the informant with iron Dab on the head causing bleeding injury.
The case diary has been received wherein the injury report of the son of the informant , namely, Baban Pd. Gupta is available. The doctor has found grievous injury on the person of the son of the informant. It is mentioned in the injury report that patient arrived in PHC in serious condition with bleeding from scalp and was bandaged tightly and also irregularity was
Patna High Court Cr.Misc. No.27127 of 2018(3) dt.20-06-2018 2/2 found on the forearm . He was sent to PMCH for further treatment. The injury was found by the doctor to be grievous in nature. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
