JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2025 Heard Mr. Krishna Prasad Singh, learned senior counsel appearing on behalf of the petitioner and Mr. Pramod Kumar Pandey, learned A.P.P. appearing on behalf of the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act and Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 19.600 Kgs of Ganja was recovered from the house of this petitioner.
4. It is submitted by learned senior counsel for the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from conscious possession of this petitioner and has been made an
Patna High Court CR. MISC. No.42924 of 2025(3) dt.19-09-2025 2/2 accused in this case merely on suspicion. Moreover, the alleged recovered contraband is less than commercial quantity. Charges have already been framed against this petitioner vide order dated 09.07.2025 and petitioner is in custody since 10.01.2025.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation and period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeIII-cum-Special Judge, N.D.P.S., Supaul in connection with Supaul Excise P.R. Case No. 09 of 2021.
