Indisputably, the petitioner had moved earlier before this Court in CWJC No.1281 of 2010 for almost identical reliefs and for redressal of his valid grievances with respect to the lands in question. The aforesaid CWJC No.1281 of 2010 was finally disposed of by an order dated 25.02.2010 (part of Annexure-1 series) by a Bench of this Court (Coram: V.N.Sinha, J. since superannuated). Thereafter, the petitioner filed MJC No.2637 of 2010 alleging non-compliance of the aforesaid order dated 25.02.2010 passed in aforesaid CWJC No.1281 of 2010. The aforesaid contempt petition was finally disposed of by the same Bench by an order dated 16.05.2011, which is also a part of Annexure-1 series.

Patna High Court CWJC No.23231 of 2013 (2) dt.04-01-2016 The grievance of the petitioner is that, despite the aforesaid orders, the valid grievances of the petitioner are not being redressed. Since with respect to the claims raised on behalf of the petitioner orders have already been passed by a Bench of this Court; therefore, fresh order is not required to be passed for the same cause of action. However, liberty is granted to the petitioner to approach the District Collector, Buxar for redressal of his valid grievances in the light of the orders and directions issued by this Court, as contained in Annexure-1 series. If such a representation is filed on behalf of the petitioner within a period of one month from today with a certified copy of the present order, then the respondent District Collector, Buxar shall consider and decide the valid claims of the petitioner strictly in accordance with law by a reasoned and speaking order at an early date preferably within a period of three months from the date of filing of such representation.

The writ petition stands finally disposed of with the observations and directions made above.
