The petitioner apprehends his arrest in Patahi P.S. Case No.82 of 2018 registered under Sections 498A and 34 of the Indian Penal Code and under sections 3⁄4 of the D.P. Act. Learned counsel for the petitioner submits that the petitioner was granted provisional bail by order dated 10.10.2018 passed in Cr.Misc.No.57743 of 2018 on his undertaking that he will keep his wife with all honour and dignity but the wife did not accompany the petitioner and the wife of the petitioner picked up a quarrel, therefore, the petitioner could not keep his wife. It is submitted that on such the provisional bail granted to the petitioner was not extended

Patna High Court CR. MISC. No.44601 of 2019(2) dt.19-07-2019 2/2 and, therefore, the petitioner again moved this court for grant of anticipatory bail.

It appears that by order dated 10.10.2018 passed in Cr.Misc.No.57743 of 2018 the petitioner was granted provisional bail for six months on his undertaking that he will keep his wife with all honour and dignity but from perusal of order passed by learned Sessions Judge, it appears that the petitioner did not keep his wife with all honour and dignity and accordingly, provisional bail of the petitioner granted by this court was not extended.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
