JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 22-03-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 882 of 2017, instituted under Sections 363 and 366 of the Indian Penal Code.

3. As per the prosecution case, wife of the complainant has been enticed away by the petitioner and kidnapped her with intention to sell her or for the purpose of illegal act.

4. Learned counsel for the petitioner submits that

Wife of the complainant was married with the complainant by her father against her will and the complainant's family tortured her due to which she left her matrimonial house. Wife of the complainant is major. Petitioner has no criminal antecedent. He undertakes to co-operate in the trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VII, Vaishali at Hajipur in connection with Complaint Case No. 882 of 2017, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
