JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2018 The petitioner is apprehending his arrest in connection with Belhar P.S. Case No. 214 of 2017, registered for offences punishable under Section 379 of the Indian Penal Code. Allegation against the petitioner and ors as per F.I.R. is of commission of theft of the battery used in the Mobile tower of the B.S.N.L.

It has been submitted on behalf of the petitioner that petitioner is not named in the F.I.R. and his name has transpired during the investigation only on the basis of confession of other co-accused of this case.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and nature of allegation, I am not

Patna High Court Cr.Misc. No.18892 of 2018 (4) dt.30-04-2018 2/2 inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly this application is dismissed.

However, the petitioner may surrender before the court below and pray for regular bail and if any such application is filed, the court below shall consider the same on the basis of material available on record and shall pass an appropriate order, if possible, on same day.
