The petitioner is in custody since 08.05.2023 in connection with JAM P.S. Case No. 632 of 2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.
There is recovery of 169.920 liters of foreign liquor from the car.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to politics. He further submits that the petitioner was not arrested on the spot and nothing has been recovered from the possession of the petitioner. He next submits that there is no independent witness of the seizure list which creates serious doubts upon the
Patna High Court CR. MISC. No.46119 of 2023(2) dt.04-08-2023 2/2 prosecution story. The petitioner has no criminal antecedent. However, learned A.P.P. appearing on behalf of the State vehemently opposed the bail application. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-II, Jamui in connection with JAM P.S. Case No. 632 of 2023.
The petitioner is directed to appear before the Mokama Police Station on the 1st Sunday of each month. (Sandeep Kumar, J) Saif/- U T
