The petitioner apprehends his arrest in a case under Section 403, 420 and 120B of the Indian Penal Code. The complainant alleged that petitioner and Yogendra Sah took Rs. 5,000 /- from the complainant on the pretext of providing job but neither job was provided nor money was returned.
The learned counsel for the petitioner submits that petitioner was an employee of the Society but he is ready to return Rs. 5,000/- to the complainant within one month. The learned counsel for the complainant has no objection if the money is returned to the complainant. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named
Patna High Court Cr.Misc. No.12561 of 2016 (3) dt.24-06-2016 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Supaul in complaint Case No. 254 C of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, subject to the condition that petitioner shall return Rs. 5,000/- to the complainant within one month.
If the petitioner fails to return Rs. 5,000/- to the complainant within one month, the learned court below shall be at liberty to cancel the bail bonds of the petitioner. (Prabhat Kumar Jha, J) BKS/- U T
