JUSTICE PARTHA SARTHY ORAL ORDER 09-04-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Bajpatti P.S. Case no.405 of 2019 registered under section 394 of the Indian Penal Code and sec 27 of the Arms Act.
As per allegation in the F.I.R., it is stated by the informant that he received information that three unknown accused persons had shot his son and had escaped with his bag. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in the confessional statement of the petitioner made before the police in another case i.e Riga P.S. Case no. 32 of 2020. He is in custody since 29.5.2020 but has
Patna High Court CR. MISC. No.41086 of 2020(3) dt.09-04-2021 2/2 not been put on T.I. Parade. There is no recovery of any incriminating article from his possession and chargesheet has been submitted in the case.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration that no incriminating article has been recovered from the petitioner's possession and charge sheet has been submitted, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Bajpatti P.S. Case no.405 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi.
