The petitioner seeks bail in connection with Kotwali (Barari) P. S. Case No.801 of 2020, instituted for the offences under Sections 413, 414 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 21.12.2020, charge-sheet has been submitted in this case and has antecedents of three cases and it is alleged that the stolen tempo was recovered from the possession of the petitioner and Gaurav Mukherjee. It is further alleged that from the petitioner, a bunch of key were also recovered. Petitioner disclosed that they had stolen the auto from Jyoti Vihar Colony.

Patna High Court CR. MISC. No.55284 of 2021(2) dt.22-02-2022 2/2 The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. After the recovery of the auto, the petitioner came to be implicated based on his antecedents.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P. S. Case No.801 of 2020, subject to condition that one of the bailors shall be the father of the petitioner namely, Baijnath Mandal and in the event, if the petitioner is implicated in a case of similar nature, the learned Court below will forthwith cancel his bail bonds. The application stands allowed.
