2. Petitioner seeks regular bail in connection with Sarsi P.S. Case No. 17 of 2025 dated 01.02.2025 registered for the offences punishable under sections 126(2), 115(2), 109, 74, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.
3. The main submissions advanced by learned senior counsel appearing for the petitioner are that though this petitioner is named in the FIR but against this petitioner there is no specific allegation, he and co-accused persons, namely, Vijay Goswami, Suraj Goswami and Manoj Goswami were alleged to have assaulted the informant's father by means of lathi and ironrod and out of these, two co-accused persons, namely, Vijay
Patna High Court CR. MISC. No.50500 of 2025(2) dt.11-08-2025 2/3 Goswami @ Vijay Kumar Goswami and Suraj Goswami @ Suraj Kumar, have been granted bail by a co-ordinate bench of this Court vide order dated 29.05.2025 passed in Cr. Misc. No. 28416 of 2025, in fact a marpit took place in between both the parties due to previous land dispute resulting in injuries to both the sides, for which the petitioner himself lodged Sarai P.S. Case No. 18 of 2025, of which a copy has been filed with this petition as Annexure- 2. It is lastly submitted that the petitioner has fair and clean antecedent and has been languishing in jail since 20.04.2025 and against him, the investigation has been completed and from the petitioner's side, some persons also sustained injuries in the alleged occurrence and in this regard, FIR lodged by the petitioner is relevant in itself.
4. Learned APP for the State has opposed the prayer of the petitioner.

Considering the aforesaid submissions and mainly the facts that there is a case and counter case in between both the parties and as per the above submission, from the petitioner's side some persons also sustained injuries in the alleged occurrence and two similarly situated co-accused persons, namely, Vijay Goswami @ Vijay Kumar Goswami and Suraj Goswami @ Suraj Kumar, are on bail, coupled with
Patna High Court CR. MISC. No.50500 of 2025(2) dt.11-08-2025 3/3 completion of investigation against this petitioner as well as his fair and clean antecedent, I am inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Sarsi P.S. Case No. 17 of 2025.
