The petitioner apprehends his arrest in Rampur P. S. Case No. 19 of 2017 registered for the offences under Sections 376, 511, 354(B)(C), 501 and 506 of the Indian Penal Code.

The informant alleged that while she was going to her house with her friend, one Taukir Khan @ Man Khan caught her hand and abused her. He caught her hairs and torn her clothes. In the meantime, his brother Gulab Khan snapped photographs. It is further alleged that Taukir Khan took her in the house and tried to outrage her modesty. On alarm, her uncle and father came to save her, but the petitioner and others threatened her uncle and father.

Patna High Court Cr.Misc. No.16185 of 2017 (2) dt.25-04-2017 2/2 Learned counsel for the petitioner submits that although the petitioner is named in the F.I.R., but no specific allegation has been made against the petitioner. The petitioner has been implicated in this case only because he happens to be own brother of Md. Taukir Khan @ Man Khan and Gulab Khan. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Rampur P. S. Case No. 19 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
