JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 26-04-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Athamalgola P.S. Case No. 151 of 2016 for the offences punishable under sections 452, 354, 341, 323, 504 and 506 of the I.P.C.
Allegedly, the petitioner entered into the house of the informant and started teasing her and when she cried she was assaulted and then her cousin sister Ashtha Kumari came for rescue who was also assaulted and then the petitioner went away after causing threats. Earlier also when the informant used to go for study the petitioner used to tease her.
Submission is of false implication and that the
Patna High Court Cr.Misc. No.13620 of 2017 (2) dt.26-04-2017 2/2 prosecution story appears not probable and reliable, no one has tried to catch the petitioner, the petitioner is the student and has been made victim of the circumstances, the informant has lodged purely a false case and as such the petitioner deserves sympathetic consideration.
The learned A.P.P. seriously opposes prayer for prearrest bail of the petitioner. In the facts and circumstances as stated above, considering the allegation, I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of S.D.J.M.
