The petitioner apprehends his arrest in Ladaniya P.S. Case No. 38 of 2016 instituted for the offence under Section (s) 406, 420, 504, 506 of the Indian Penal Code. As per written report, an amount of Rs. 80,000/- was given to the petitioner by the informant on 23.07.2010 for purchase of land as mentioned in the written report. The petitioner neither executed sale deed nor returned the money. From the written report itself, it appears that the alleged occurrence has taken place on 23.07.2010 and this F.I.R. has been registered in the year 2016 after delay of six years. In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Ladaniya P.S. Case No. 38 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Madhubani, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
