JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the State. Petitioners apprehend arrest in a case under section 307/34 and other allied sections of the Indian Penal Code. The allegation of making assault by Garasa is against accused Nitish Kumar, whereas allegation of assault by Lathi is against the petitioners, two of whom are ladies. The petitioners submit that there is general allegation against them of making assault by Lathi.

In the facts and circumstances of the case, in the event of arrest/surrender, let all the three petitioners, mentioned above, be released on bail on furnishing bail bond of Rs.5,000/-

Patna High Court Cr.Misc. No.21406 of 2016 (2) dt.19-05-2016 2/2 each with two sureties of the like amount each to the satisfaction of JM 1st class, Biharsharif, Nalanda in Ruhai, Bhagan bigha Police station Case No. 02 of 2016. Petitioner no.1 would not be absent physically for two consecutive dates at a stretch till two witnesses are examined in the trial, failing which his bail bond would be liable to be cancelled.
