The petitioner apprehends his arrest in Arrah Town P.S. Case No.461 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant disclosed that he got information that one Md. Alamgir and Md. Anish had kept liquor in autorickshaw and on such, raid was conducted. Md. Alamgir and Md. Anish were apprehended, who disclosed that with the help of Sudhir Kumar (owner of auto-rickshaw) they used to transport liquor for the purpose of sale.

Learned counsel for the petitioner submits that the petitioner is the real owner of the auto-rickshaw. He had given his auto-rickshaw on lease to Sudhir Kumar for transportation of children from school to their residence, but Sudhir Kumar

Having considered the facts aforesaid and the fact that the petitioner has got no criminal antecedent, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge-cumSpecial Judge, Excise, Bhojpur in connection with Arrah Town P.S. Case No.461 of 2018 (Excise Case No.1271 of 2018) subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
