The petitioner seeks bail in Sakra P.S. Case No. 265 of 2021, registered for the offence punishable under Sections 379, 420 and other allied sections of the Indian Penal Code, section 7 of the Essential Commodities Act, and section 51-60 of the Disaster Management Act.

On secret information a raid was conducted and from house of this petitioner covid-19 (Rapid) Antigen kit 13 pcs., Abbot Company Rapid Antigen kit-40 pcs., Cotton (big)-10 pcs., Sanitizer- 9 pcs, Lux soap-40 pcs, Swab- 8 pcs, PPE Kit-2 set, Nebulizer machine- 1pc, case guard - 1 pc, valve -4 pcs and hand gloves - 40 pcs has been recovered.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Petitioner is

No.56481 of 2021(2) dt.07-12-2021 2/2 employee of Sadar Hospital Muzaffarpur on the post of Lab Technician in the department of Nasa Mukti Kendra Sadar Hospital, Muzaffarpur and was engaged in covid-19 work and the work of petitioner relates to testing of covid-19 patient and submit patient report to the hospital and after finishing the test work the petitioner has to return the rest material to the hospital therefore, there is no question of blackmarketting. Petitioner claims clean antecedent and he is in custody since 11.05.2021. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, East Muzaffarpur in connection with Sakra P.S.
