Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201/34 of the Indian Penal Code.

As per the prosecution case, 2-3 unknown miscreants committed the murder of nephew of informant. Name of petitioner has transpired in this case on the basis of information of police spy.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Save and except confessional statement of petitioner there

Patna High Court CR. MISC. No.55165 of 2021(3) dt.29-01-2022 2/2 is no material against him to show his complicity in the aforesaid crime. Petitioner claims clean antecedent and is in custody since 09.06.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner made his confessional statement and on the basis of disclosure made by this petitioner knife used in the crime has been recovered from his possession. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
