This application has been filed for quashing of the order dated 29.01.2018 passed by learned Judicial Magistrate, 1st Class, Patna, in Mahila P.s. Case No. 43 of 2014, by which the learned Magistrate has taken cognizance against the petitioner for the offence under sections 406 and 420/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.

Learned counsel for the parties submits that the parties have settled their dispute and as per the settlement
Patna High Court CR. MISC. No.32387 of 2018(3) dt.24-08-2023 2/2 learned counsel for the petitioner has handed over a demand draft of Rs.5,00,000/- to the learned counsel for the opposite party no.2.

In view of the aforesaid facts, this application is allowed. Accordingly, the F.I.R. vide Mahila P.S. Case No. 43 of 2014 and all consequential proceedings arising out of the aforesaid F.I.R. including the order dated 29.01.2018 passed by learned Judicial Magistrate, 1st Class, Patna, are hereby quashed in the interest of justice.
