The Opposite party No.2 has been released on compulsory bail under Section 167(2) of the Code of Criminal Procedure, 1973. The petitioner, who is informant of concerned Rajpur P. S. Case No. 223 of 2013, is aggrieved by release of Opposite party No.2 on bail under the said provisions. Upon perusal of the materials on record, it appears that within the statutory period of 90 days, till the Opposite party No.2 had applied for furnishing bail bonds before the Court below, no charge-sheet was submitted and accordingly, he was ordered to be released on bail. Only after his release on bail, the charge-sheet came to be submitted by the police.
There is no allegation of any misuse of conditions of bail allowed to Opposite party No.2.
I do not find any ground having been made out for cancellation of bail.
This application has no merit and it is, accordingly, dismissed.
