JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,452,307,302,323,325,436,379,341 and 342 of the Indian Penal Code and section 3(2)(v) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that the accused persons pressurized the informant to withdraw the case lodged for the kidnapping of girl from the informant side when the accused persons assaulted the informant, his sons and others.

Subsequently, the son of the informant succumbed to the injury. The accused persons set the informant's house on fire. It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.14307 of 2016 (2) dt.01-04-2016 2/2 that the accusation is not specific against the petitioners and there is counter version of the occurrence also.

Let the learned court below consider the prayer for regular bail of the petitioners in case the petitioners surrender within six weeks from today in connection with Gopalpur P.S. Case No. 177 of 2015 pending in the court of learned C.J.M. Bhagalpur. This application is disposed of with the aforesaid observation/direction.
