JUSTICE SANJAY PRIYA ORAL ORDER 2/ 29-07-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Informant. Petitioner seeks bail in Kotwali P.S. Case No.188 of 2019 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code and Section 27 of the Arms Act.
In the written report, it is alleged that on the date of occurrence this petitioner and other accused along with 2-3 unknown armed with firearm, in conspiracy, fired on the informant. When the informant tried to run away, Piyush fired upon his right hand and Prince also fired causing injury in his left thigh. It is further alleged that on the order of Sukho Mandal, this petitioner along with two other unknown also fired causing injury in the chest and neck of the informant. It is further alleged that Sumo Mandal caused injury to the informant
Patna High Court CR. MISC. No.45692 of 2019(2) dt.29-07-2019 2/2 by assaulting with stone on his head.
Counsel for the petitioner submits that injury report of the informant is enclosed as Annexure-2 from which it will appear that informant has sustained two firearm injuries; one on the elbow joint and another on left thigh. The doctor has found one injury to be grievous in nature and another to be simple in nature caused by firearm.
Counsel for the informant has appeared and opposed prayer for bail.
Petitioner is in custody since 21.05.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger, in connection with Kotwali P.S. Case No.188 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
